Instructions for obtaining a building permit for facilities which within the IPARD program are built on construction land with adopted urban plan documentation.


Required Documentation

 

To obtain a building permit the developer shall submit a written application to the municipality on which territory the facility has to be built.

 

To the application shall be submitted the following documents:

 

1. Extract from the planning documentation (detailed urban plan or urban plan for uninhabited areas or urban plan for a rural settlement or local urban planning documents).

 

2. Architecture and urban design certified by a competent authority if a local urban plan or urban planning documentation is provided for the preparation of this project; 

 

3. Main Project in three copies, including an assessment report on the main design or a written report including approval for verification of the main project if designed abroad;

 

4. Evidence of the right to build (title deed with registered ownership right or the right on long-term lease or easement of the construction land to the applicant or an agreement for transfer of the right to build on the construction land in subject);

 

5. Geodetic survey to obtain numerical data on the construction land.

 

Note:

The Main Project contains an assessment study on the environmental impact of the project or an elaboration on environmental protection approved by a competent authority, if the regulations in the area of environmental protection provide preparation of a study or a report on these constructions.

 

Procedure for issuing a building permit

The municipality shall, within 15 days of receipt of the application to review the submitted documentation and determine whether it is complete, if the basic design is prepared in accordance with legal regulations and the planning documents and whether the applicant is the sole beneficiary of the right to build.

If the submitted documentation is complete, the competent authority shall notify the entities responsible for electricity, water and sewerage infrastructure and other relevant entities determined by the Construction Law, which are obliged to inspect the project and communicate any objections in the inspection report.

If the main design is prepared in accordance with legal regulations and the planning documents, the entities responsible for electricity, water and sewerage infrastructure or other responsible entities have no objections and the applicant is the sole beneficiary of the right to build, the competent authority shall certify the main design and submit a notification to the applicant with the calculation of payment of compensation for arrangement of construction land (utilities).

The developer is obliged to pay compensation for regulation of the land or the municipality to enter into an agreement for the payment of compensation for regulation of the land in installments or to sign a contract that stipulates that the developer will regulate the land at his own expense or to submit a bank guarantee of payment of compensation or to establish a mortgage in favor of the municipality and the municipality can adopt an act which may exempt the developer from payment of the fee.

A building permit is issued within five working days of submission of proof of the fee paid for regulation of the construction land (utilities). 

 

Procedure when submitted documentation is incomplete or incorrect

 

If the submitted documentation is incomplete and/or the main design is not prepared in accordance with legal regulations and the planning documents, the entities responsible for electricity, water and sewerage infrastructure and other relevant entities have remarks and/or the applicant is not the only beneficiary of the right to build, the municipality is obliged to issue a conclusion terminating the proceedings and ask the applicant to correct the deficiencies and to supplement the application within 15 days of receipt.

If the applicant fails to remedy the deficiencies and supplement the application, the competent authority shall issue a decision rejecting the application for a building permit within seven days of expiry of the deadline for completion, and provided the applicant remedies the deficiencies and supplements the application, the competent authority shall submit to the applicant a notification calculation for payment of compensation for arrangement of construction land (utilities), within two days of completion of the documents.
